These Terms of Use, Gift Card Terms, Fleet Card Terms, and Legal Conditions (collectively, the “Terms“) govern your access to and use of the website located at http://s32.c4c.mywebsitetransfer.com (the “Site“), and any related online services, cards, or programs offered by Cascade Car Wash®, together with its affiliates and related entities (collectively, “Cascade Car Wash,” “CCW,” “we,” “us,” or “our“). By accessing or using the Site, purchasing products or services, or using any CCW gift card, recharge card, fleet card, or other stored value product (collectively, the “CCW Programs”), you agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue use of the Site and Services immediately.

0. Acceptance of Terms Upon Wash Purchase

By selecting, purchasing, or initiating any car wash service at a Cascade Car Wash® Facility or through the Site, you expressly acknowledge and agree that:

  • You have read, understand, and fully accept these Terms of Use;
  • You agree that Cascade Car Wash is not responsible for any damage to your vehicle;
  • You voluntarily enter the wash tunnel and use the Facilities entirely at your own risk;
  • Your purchase of any wash constitutes your full and binding acceptance of these Terms.

If you do not agree to these Terms, do not proceed with the purchase or use of any wash service.

1. Definitions

For purposes of these Terms:

“User,” “you,” and “your” mean any individual or entity accessing or using the Site or CCW Programs.
“Services” means vehicle washing services, vacuum services, online purchases, customer programs, and related offerings provided by CCW.
“Facilities” means any physical Cascade Car Wash® location.
“Gift Cards” means CCW Gift Cards, Recharge Cards, Stored Value Cards, or Customer Value Cards.
“Fleet Cards” means commercial-use cards issued under CCW’s Fleet Programs.
“CCW Content” means all text, graphics, logos, images, and materials on the Site.

2. Geographic Scope and Eligibility

The Site and CCW Programs are intended for customers in the United States, primarily Ohio. All transactions occur in Ohio, and all Services are performed in Ohio. You must be at least 18 years old to use the Site or participate in the CCW Programs.

3. Modification of These Terms

We may update, change, or modify these Terms at any time. All modifications are effective immediately upon posting. Your continued use of the Site or CCW Programs after changes are posted constitutes your acceptance of the revised Terms. You should review the Terms regularly.

4. Use of the Site

You agree to use the Site only for lawful purposes. You may not:

  • Damage, disable, or impair the Site.
  • Attempt unauthorized access to any CCW system, network, or data.
  • Use robots, scrapers, or automated tools without permission.
  • Reverse engineer, copy, or create derivative works based on the Site or CCW Content.
  • Use the Site for competitive analysis, data mining, or commercial misuse.
  • Upload viruses, malware, or harmful code.
  • Impersonate others or engage in fraud.
  • Harass, defame, or threaten others.

4.1 Interactive Features and User ConductThe Site may, now or in the future, include forms, review tools, surveys, promotional entries, or other features that allow you to submit messages, ratings, images, or other content (collectively, “Interactive Features”). You agree to use all Interactive Features only for lawful purposes and in a manner consistent with these Terms.

When using any Interactive Feature, you agree that you will not:

  • Defame, abuse, harass, threaten, or otherwise violate the legal rights or privacy of others.
  • Post or transmit any content that is obscene, hateful, unlawful, infringing, or otherwise inappropriate.
  • Upload or share files or software that you do not have the legal right to distribute, including content protected by copyright, trademark, or other proprietary rights.
  • Upload or transmit viruses, corrupted files, malware, or other code intended to damage or interfere with the operation of the Site or any equipment.
  • Use the Site to advertise or solicit for any business purpose not expressly authorized by CCW.
  • Harvest or collect information about other users without their consent.
  • Violate any applicable laws or regulations.

CCW is not obligated to monitor any Interactive Features, but reserves the right, in its sole discretion, to review, remove, or refuse to post any content, and to suspend or terminate access to the Site or any Interactive Feature at any time without notice.

Content submitted through Interactive Features is also governed by Section 11 (User Submissions and Feedback).

5. Third-Party Links and Services

The Site may contain links to third-party websites. CCW is not responsible for third-party content, security practices, or privacy policies. Your use of third-party services is at your own risk.

6. Gift Cards, Recharge Cards, and Customer Value Cards

6.1 General

Gift Cards may be purchased online or within Facilities and may be used only at participating Cascade Car Wash® locations.

6.2 Activation, Balance, and Use

  • Gift Cards activate at purchase.
  • Balances decrease with each transaction.
  • Balances may not exceed limits set by CCW.
  • Gift Cards are not legal tender, not deposit accounts, and not interest-bearing.
  • Unless stated otherwise, Gift Cards are reloadable.
  • Resale without written authorization from CCW is prohibited.
  • CCW may rely on electronic transaction logs as final proof of balance.
  • Customers may check current Gift Card balances at any time by visiting the Site and using the online balance-lookup tool.
  • When you recharge or add funds to any Gift Card, Recharge Card, or Customer Value Card, the updated balance may take up to twenty-four (24) hours to appear in your account or be available for use.

6.3 Inactivity, Deactivation, and Reactivation

CCW may deactivate any Gift Card showing 24 months of inactivity. Cards may be reviewed and potentially reactivated upon proof of purchase.

6.4 Refunds

Except where required by law, Gift Cards are non-refundable and not redeemable for cash. When required by applicable law, CCW may issue the minimum lawful refund, including by re-crediting the Gift Card.

6.5 Loss, Theft, or Damage

CCW is not responsible for lost, stolen, damaged, or unauthorized card use.

6.6 Fraud and Abuse

CCW may suspend, deactivate, or cancel any Gift Card involved in fraud, abuse, or system error.

7. Fleet Card Programs

7.1 Enrollment and Eligibility

Fleet Cards are available only to approved commercial customers. CCW may approve, deny, or terminate any Fleet account at its sole discretion.

7.2 Billing, Credit Terms, and Responsibility

  • Maintain accurate contact and billing information.
  • Pay all charges in U.S. dollars.
  • Pay late fees, service charges, or interest permitted by Ohio law.
  • Review statements regularly.
  • Notify CCW immediately of suspected misuse.

7.3 Misuse and Suspension

CCW may suspend or terminate any Fleet account for fraud, misuse, late payment, or conduct that poses a risk to CCW.

8. Vehicle Use, Safety, and Damage Allocation

8.1 Vehicle Condition Requirements

By using Facilities, you confirm your vehicle is structurally sound, including:

  • Secured mirrors, trim, antennas, racks, and accessories.
  • Closed windows, sunroofs, and convertible tops.
  • No loose, rusted, or damaged components.
  • Proper tires, suspension, and steering.
  • No oversized, lifted, or aftermarket modifications exceeding manufacturer recommendations.

8.2 Aftermarket Parts and Accessories

CCW is not responsible for damage to aftermarket, non-factory, or specialty items including light bars, visors, wraps, spoilers, racks, custom rims, or similar components.

8.3 Pre-Existing and Incidental Damage

CCW is not responsible for:

  • Pre-existing dents, scratches, rust, oxidation, fading, or deterioration.
  • Damage revealing or worsening pre-existing conditions.
  • Normal wear associated with washing.

8.4 Personal Property

CCW is not responsible for personal items left inside the vehicle. Remove valuables before entering.

8.5 Safety Rules

You must follow all posted signs, instructions, and staff directions. CCW may refuse service for safety reasons.

8.6 No Insurance Coverage

CCW does NOT provide insurance coverage for vehicle damage. Your auto insurance policy may provide coverage.

8.7 Damage Claims Procedure (For Documentation Purposes Only)

CCW is not responsible for any damage to vehicles. All customers enter and use the Facilities at their own risk, as clearly posted at the entrance of each wash location.

However, if you wish to submit information for documentation and review, you must strictly follow the procedure below. Submission of a claim does not imply acceptance of liability by CCW.

To submit a damage report, you must:

  • Report the issue immediately before leaving the Facility.
  • Complete an incident report with accurate information.
  • Provide clear photos of the alleged damage.
  • Allow CCW to inspect the vehicle.
  • Submit the claim within twenty-four (24) hours of the incident.

Failure to meet all requirements will result in dismissal of the claim without review. Acceptance of a claim for review is not an admission of fault or liability by CCW.

9. Online Purchases and Payments

Online purchases may be processed by third-party payment processors. You authorize CCW or its processor to charge your payment method. You agree not to initiate a chargeback without first contacting CCW.

10. Intellectual Property

All CCW Content is protected by intellectual property laws. You may not copy, modify, reproduce, or distribute any CCW Content without written permission.

11. User Submissions and Feedback

If you submit feedback, reviews, or suggestions, you grant CCW a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, publish, or modify such content. You waive all moral rights you may hold in the submitted content.

12. Disclaimers

To the fullest extent permitted by law:

  • The Site, Services, Products, and CCW Content are provided “AS IS” and “AS AVAILABLE”.
  • CCW disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, and continuous service.
  • CCW does not guarantee specific cleaning results.

12A. Website Disclaimer and Online Service Limitations

The Site, including all information, text, graphics, software, tools, balance-lookup features, online purchasing functions, and all related content, may contain errors, inaccuracies, or omissions. Information on the Site may be updated or changed at any time without notice. Cascade Car Wash® does not guarantee that the Site will be uninterrupted, error-free, current, or free of technical issues.

All information, software, products, and services provided through the Site are made available on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind, whether express or implied.

To the fullest extent permitted by law, Cascade Car Wash® expressly disclaims all warranties, including but not limited to:

  • warranties of merchantability;
  • warranties of fitness for a particular purpose;
  • warranties of title;
  • warranties of non-infringement;
  • warranties arising out of usage, course of dealing, or trade practice.

Cascade Car Wash makes no representations about the accuracy, reliability, availability, completeness, or timeliness of any information, software, or services available through the Site.

You should not rely on any information provided on the Site when making decisions regarding your vehicle, legal matters, financial matters, or maintenance decisions. You are solely responsible for verifying any information before relying on it.

To the maximum extent permitted by law, Cascade Car Wash shall not be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages whatsoever, including but not limited to damages for loss of use, loss of data, service interruptions, website downtime, inability to process online payments, errors in gift card balance display, or any other loss arising out of or related to your use of the Site.

If you are dissatisfied with any portion of the Site, its content, or these Terms, your sole and exclusive remedy is to discontinue using the Site.

13. Limitation of Liability

To the fullest extent permitted by Ohio law:

  • CCW is not liable for indirect, incidental, special, punitive, or consequential damages.
  • Total liability for any claim shall not exceed Fifty U.S. Dollars (US $50).

These limitations do not apply where prohibited by law, including claims involving intentional misconduct or personal injury caused directly by CCW.

14. Indemnification

You agree to indemnify, defend, and hold CCW harmless from claims arising from:

  • Your use of the Site, Services, or Facilities.
  • Your vehicle’s condition, contents, or modifications.
  • Your breach of these Terms.
  • Your violation of law or third-party rights.

15. Dispute Resolution, Arbitration, and Governing Law

15.1 Governing Law

These Terms are governed exclusively by Ohio law.

15.2 Arbitration

All Disputes must be resolved by binding arbitration in Montgomery County, Ohio, before a neutral arbitrator. The Federal Arbitration Act governs enforceability.

15.3 Court Jurisdiction

If arbitration becomes unavailable, Disputes shall be heard exclusively in Ohio state courts located in Montgomery County.

15.4 No Class Actions

All Disputes must be brought individually, not as part of a class or representative action.

16. Termination and Suspension

CCW may suspend or terminate your access to the Site or CCW Programs at any time for violations, fraud, or conduct harmful to CCW.

17. Force Majeure

CCW is not liable for delays or failures caused by:

  • Weather
  • Mechanical or equipment failure
  • Power outages
  • Supply chain issues
  • Cyberattacks
  • Labor disputes
  • Government actions
  • Public emergencies or pandemics

18. Miscellaneous

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the fullest extent permissible and the remaining provisions will remain in full force and effect.

No waiver of any term is effective unless it is in writing and signed by CCW. Any failure by CCW to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and CCW. You may not assign or transfer your rights or obligations under these Terms without CCW’s prior written consent; CCW may assign these Terms at any time without notice.

CCW’s performance under these Terms is subject to existing laws and legal processes, and nothing in these Terms limits CCW’s right to comply with governmental, court, or law-enforcement requests relating to your use of the Site or information provided to or collected by CCW.

These Terms, together with any additional terms presented at the time of purchase or enrollment in a specific CCW Program, constitute the entire agreement between you and CCW with respect to your use of the Site and CCW Programs and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.

20. Copyright Complaints and DMCA Notices

CCW respects the intellectual property rights of others and expects users of the Site to do the same. If you believe that any content on the Site infringes your copyright, you may notify CCW’s designated contact with a written notice that includes:

  • Your name, address, telephone number, and email address;
  • A description of the copyrighted work you claim has been infringed;
  • A description of where the allegedly infringing material is located on the Site;
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
